Previewing ® does not mean your brand is registered. Verify status before using it publicly.

TM vs. ® vs. ℠: What Is the Difference?

The trademark symbol ™ is commonly placed after a brand name, product name, or slogan to signal a claimed trademark. It does not certify that the mark is registered. The registered trademark symbol ® is reserved for marks with an applicable trademark registration; requirements differ by jurisdiction. The service mark symbol ℠ is associated with marks for services and is encountered especially in the United States.

For instance, the hypothetical label Example Brand™ expresses a claim to the brand mark, while Example Brand® would only be appropriate when the relevant registration exists. The symbols themselves do not tell you who owns a mark or whether it is safe to adopt that name.

Where Should a Trademark Symbol Be Placed?

Place ™, ® or ℠ immediately after the brand name, logo wording, or slogan you are identifying, often raised slightly in typeset designs: Example Brand™. You generally do not need to repeat the symbol after every mention in running text; brand style guides and local legal advice may recommend particular usage.

Trademark vs. Copyright

A trademark helps identify the commercial source of particular goods or services, whereas copyright generally concerns qualifying original creative expression. ™ and ® are trademark-related; © is the copyright notice sign. A single product may involve both kinds of rights, but the symbols are not interchangeable. For copyright notices, use the standard © sign rather than a trademark symbol.

Does Adding ™ Automatically Protect a Brand?

No. Trademark rights depend on applicable law and facts such as the mark, jurisdiction, use, and registration. A symbol can communicate a claim, but it does not replace clearance searches, trademark applications, or professional advice when needed.

Important legal note: Using ® before a qualifying registration exists, or outside the scope of an applicable registration, can be misleading or unlawful. Always check your country's rules and registration details. This page offers general educational information, not legal advice.

Trademark Symbols: Frequently Asked Questions

How do I copy and paste the TM symbol?

Click the “Copy ™” button, then paste with Ctrl+V on Windows or Command+V on Mac. On phones, long-press in a text field and select Paste.

What is the difference between ™ and ®?

™ indicates a claim to a trademark, without claiming registration. ® is a registered trademark sign and should only be used where an applicable registration authorizes it.

Can I use ™ without registering a trademark?

Generally, ™ can signal a trademark claim without a registration, but the existence and scope of legal rights depend on local law and circumstances.

Can I use ® while my trademark application is pending?

Normally no. An application is not the same as a registration. Confirm the applicable registration and territory before using ®.

What does ℠ mean?

℠ stands for service mark and is used to identify marks associated with services, rather than goods, in jurisdictions where this terminology is used.

What is the HTML code for the registered trademark sign?

Write ® or ® in HTML source. Both render as ®.

How do I type ™ on Windows and Mac?

On many Windows setups use Alt+0153 with a numeric keypad. On many Mac layouts press Option+2.

Should a trademark symbol be superscript?

It is often displayed smaller and raised after the mark, but the symbol does not need a special Unicode superscript form: ™ is already designed for this usage.
